Thanks for using Self-Match LLC (“Self-Match”) products and services (“Services”).
These Terms of Use (“ToU”) contain the terms under which Self-Match provides its Services to you and describe how the Services may be accessed and used.

“User”– any person who engages in using the services provided by Self-Match. “Partner”- anyone who may have interacted or may potentially interact with a User over Self-Match. The term does not imply any commitment while used in the limits of the site. Sometimes Self-Match Users can be called Members. The term Member does not imply any paid membership at this time.

You indicate your agreement to these Terms by checking the box indicating your acceptance of these Terms or by using the Services. If you do not accept and agree to be bound by all of the terms of this Agreement, including the Self-Match Privacy Policy, do not use the Website or the Service.

Self-Match.com may modify this Agreement from time to time and such modification shall be effective upon posting by Self-Match.com on the Website. You agree to be bound to any changes to this Agreement when you use the Service after any such modification is posted. This Agreement includes Self-Match.com's policy for acceptable use and content posted on the Website, your rights, obligations and restrictions regarding your use of the Website and the Service and Self-Match.com's Privacy Policy.

Please choose carefully the information you post on Self-Match.com and that you provide to other Users. Any photographs posted by you may not contain nudity, violence, or offensive subject matter. Information provided by other Self-Match.com Users (for instance, in their Profile) may contain inaccurate, inappropriate or offensive material, products or services and Self-Match.com assumes no responsibility nor liability for this material.

Self-Match.com reserves the right, in its sole discretion, to reject, refuse to post or remove any posting (including email) by you, or to restrict, suspend, or terminate your access to all or any part of the Website and/or Services at any time, for any or no reason, with or without prior notice, and without lability.

1. User Eligibility

1.1. Legal Status

You must be at least 18 years old to use Self-Match services.

1.2. Relationship Status.

This service is intended for singles only. We reserve the right to decline the service for any User who we know, or suspect, may be in a committed relationship.

1.3 Other

You have never been convicted of a felony and you are not required to register as a sex offender with any government entity.

1.4 Accuracy of Information

By using the Website and the Service, you represent and warrant that all registration information you submit is truthful and accurate and that you agree to maintain the accuracy of such information. You further represent and warrant that you are 18 years of age or older and that your use of the Self-Match.com shall not violate any applicable law or regulation. Your profile may be deleted without warning, if it is found that you are misrepresenting your age. Your registration with the Service is solely for your personal use, and you shall not authorize others to use your account, including your profile or email address. You are solely responsible for all content published or displayed through your account, including any email messages, and for your interactions with other Users.

1.5 User Interactions

You are solely responsible for your interactions and communication with other Users. You understand that Self-Match.com does not in any way screen its Users, nor does Self-Match.com inquire into the backgrounds of its Users or attempt to verify the statements of its Users. Self-Match.com makes no representations or warranties as to the conduct of Users or their compatibility with any current or future Users. We do however recommend that if you choose to meet or exchange personal information with any User of Self-Match.com then you should take it upon yourself to do a background check on said person.

In no event shall Self-Match.com be liable for any damages whatsoever, whether direct, indirect, general, special, compensatory, consequential, and/or incidental, arising out of or relating to the conduct of you or anyone else in connection with the use of the Service, including without limitation, bodily injury, emotional distress, and/or any other damages resulting from communications or meetings with other registered Users of this Service or persons you meet through this Service.

2. Use of Service

2.1. The description of the service

Self-Match (self-match.com) is an innovative dating site that provides its Users with tools to explore their compatibility by means of question exchange. Self-Match has many features of typical dating sites and some unique features available only on Self-Match like Pop-a-Question feature. Self-Match uses play currency known as Self-Match bucks or $M. Users earn and spend $M by accessing different Self-Match features. Self-Match is free to use and does not have any Usership levels. In-app purchases are available for Users to boost their accessibility of different features.

2.2 User profile, information sharing, and personal safety

When creating your profile, you agree to provide your real first name (will become public information), your last name (will be kept confidential), and other personal information that will become part of your public profile. If you choose to provide your phone number, it will not be displayed to the public. We will only call you if we have an issue that we cannot resolve over the email correspondence. You will not receive any marketing calls from Self-Match.

When providing any personal information or posting any personal content to Self-Match, please use extreme caution not to put any personally identifiable ques like your physical address, specific place of employment, etc. Keep in mind that Self-Match does not conduct the background check on its Users. We will do the best we can to protect you from any harassment that happens on Self-Match by banning the other User; however, if the harassment happens outside the usage of this service, we strongly encourage you to inform the local law enforcement authorities.

2.3 Use of questions and matching results

Self-Match uses a database of original questions that may appear randomly in different features or be chosen by a User. Self-Match does nor guarantee any compatibility between two Users when they produce matching responses. In the same way, Self-Match does not guarantee lack of compatibility when the Users produce non- matching responses. Self-Match leaves it up to the User to assess levels of compatibility based on multiple questions and responses.

2.4 Self-Match play currency

Self-Match uses $M as the site’s play currency. There are two types of $M: Silver and Gold. A User can earn Silver $M by engaging in question exchange features like Pop-a-Question running feature, popping random questions, sending specific questions, viewing partner’s responses, etc. A User needs $M to open partners’ profiles, send/read messages, upload additional photos, and be able to do other things on Self-Match.

Silver $M left in the User’s account will expire after 48 hours of inactivity.

The advantage of Golden $M is that they will not expire until used and that some features can be accessed only by paying with Gold $M. The User can purchase Gold $M or convert Silver $M to Gold $M for a fee.

All in-app purchases are processed through PayPal and Stripe and are governed by their Terms of Use.

If case if your payment was processed successfully but the Gold $M balance did not increase by the purchased or converted amount, please contact Self-Match.com at support@self-match.com. State your case and request a refund. We will investigate the reason for the fault and we will act reasonably in deciding whether to grant you a refund in true or play currency or not.

Self-Match reserves the right to change the $M price assigned to any action on the site at any time as well as the price of Gold $M

3. Account Management

3.1. Keep Your Password Secure.

Upon creating a Self-Match account, you become responsible for safeguarding your password and any other credentials used to access that account. If you become aware of any unauthorized access to your account, you should notify Self-Match immediately. Accounts may not be shared and may only be used by one individual per account.

3.2. Keep Your Details Accurate.

You must keep your email address, your contact details, and payment details associated with your account current and accurate.

3.3. Account Inactivity.

Self-Match may terminate your account and delete any content contained in it if there is no account activity (such as a log in event or payment) for over 12 months. However, we will attempt to warn you by email before terminating your account to provide you with an opportunity to log in to your account so that it remains active.

4. Acceptable Uses

4.1. Legal Compliance.

You must use the Services in compliance with, and only as permitted by, applicable law.

4.2. Your Responsibilities.

You are responsible for your conduct, content, and communications with others while using the Services. You must comply with the following requirements when using the Services:

(a) You may not purchase, use, or access the Services for the purpose of building a competitive product or service or for any other competitive purposes.
(b) You may not misuse our Services by interfering with their normal operation, or attempting to access them using a method other than through the interfaces and instructions that we provide.
(c) You may not transmit any viruses, malware, or other types of malicious software, or links to such software, through the Services.
(d) You may not engage in abusive or excessive usage of the Services, which is usage significantly in excess of average usage patterns that adversely affects the speed, responsiveness, stability, availability, or functionality of the Services for other Users.
(e) You may not use the Services to infringe the intellectual property rights of others, or to commit an unlawful activity.
(f) Unless authorized by Self-Match in writing, you may not resell or lease the Services.

4.3 Non-Commercial Use

The Website is for the personal use only and may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by the management of Self-Match.com. Illegal and/or unauthorized use of the Website, including collecting usernames and/or email addresses of Users by electronic or other means for the purpose of sending unsolicited email or unauthorized framing of or linking to the Website will be investigated. Commercial advertisements, affiliate links, and other forms of solicitation may be removed from User profiles without notice and may result in termination of Usership privileges. Appropriate legal action will be taken by Self-Match.com for any illegal or unauthorized use of the Website.

5. Changes and Updates

5.1. Changes to Terms.

Self-Match may change these Terms at any time for a variety of reasons, such as to reflect changes in applicable law or updates to Services, and to account for new Services or functionality.

5.2. Changes to Services.

Self-Match constantly changes and improves the Services. Self-Match may add, alter, or remove functionality from a Service at any time without prior notice. If Self-Match discontinues a Service, we will give you reasonable advance notice to provide you with an opportunity to make an informed decision regarding continuation of your Usership.

5.3. Availability.

Self-Match is excited to provide you with a great experience when using the Services; however, despite our best efforts our services may be unavailable from time to time due to various technical reasons.

6. Proprietary Rights in Content on Self-Match.com.

Self-Match.com owns and retains all proprietary rights in the Website and the Service. The Website contains copyrighted material, trademarks, and other proprietary information of Self-Match.comand its licensors. Except for that information which is in the public domain or for which you have been given written permission, you may not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information.

6.1 Content Posted on the Site.

a. You understand and agree that Self-Match.com may review and delete any content, messages, Self-Match.com Messenger messages, photos or profiles (collectively, "Content") that in the sole judgment of Self-Match.com violate this Agreement or which may be offensive, illegal or violate the rights, harm, or threaten the safety of any User.

b. You are solely responsible for the Content that you publish or display (hereinafter, "post") on the Service or any material or information that you transmit to other Users.

c. By posting any Content to the public areas of the Website, you hereby grant to Self-Match.com the non-exclusive, fully paid, worldwide license to use, publicly perform and display such Content on the Website. This license will terminate at the time you remove such Content from the Website.

d. The following is a partial list of the kind of Content that is illegal or prohibited on the Website. Self-Match.com reserves the right to investigate and take appropriate legal action in its sole discretion against anyone who violates this provision, including without limitation, removing the offending communication from the Service and terminating the usage of such violators. Prohibited Content includes Content that:

i. is patently offensive and promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
ii. harasses or advocates harassment of another person;
iii. involves the transmission of "junk mail", "chain letters," or unsolicited mass mailing or "spamming"
iv. promotes information that you know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
v. promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;
vi. contains restricted or password only access pages or hidden pages or images (those not linked to or from another accessible page);
vii. provides material that exploits people under the age of 18 in a sexual or violent manner, or solicits personal information from anyone under 18;
viii. provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
ix. solicits passwords or personal identifying information for commercial or unlawful purposes from other users;
or x. involves commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, or pyramid schemes.

e. You must use the Service in a manner consistent with any and all applicable laws and regulations.

f. You may not engage in advertising to, or solicitation of, any User to buy or sell any products or services through the Service. You may not transmit any chain letters or junk email to other Users. Although Self-Match.com cannot monitor the conduct of its Users off the Website, it is also a violation of these rules to use any information obtained from the Service in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to any User without their prior explicit consent. In order to protect our Users from such advertising or solicitation, Self-Match.com reserves the right to restrict the number of emails which a User may send to other Users in any 24-hour period to a number which Self-Match.com deems appropriate in its sole discretion.

g. You may not cover or obscure the banner advertisements on your personal profile page, or any Self-Match.com page via HTML/CSS or any other means.

h. Any automated use of the system, such as using scripts to add friends, is prohibited.

i. You may not attempt to impersonate another user or person who is not a User of Self-Match.com.

j. You may not use the account, username, or password of another User at any time nor may you disclose your password to any third party or permit any third party to access your account.

k. You may not sell or otherwise transfer your profile.

7. Copyright Policy.

You may not post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights. It is the policy of Self-Match.com to terminate Usership privileges of any User who repeatedly infringes copyright upon prompt notification to Self-Match.com by the copyright owner or the copyright owner's legal agent. Without limiting the foregoing, if you believe that your work has been copied and posted on the Service in a way that constitutes copyright infringement, please provide our Copyright Agent with the following information: an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; a description of the copyrighted work that you claim has been infringed; a description of where the material that you claim is infringing is located on the Website; your address, telephone number, and email address; a written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf. Self-Match.com's Copyright Agent for notice of claims of copyright infringement can be reached via email address.

8. User Disputes.

You are solely responsible for your interactions with other Self-Match.com Users. Self-Match.com reserves the right, but has no obligation, to monitor disputes between you and other Users.

9. Disclaimers.

You agree that online dating can be dangerous!

Self-Match.com is not responsible for any incorrect or inaccurate content posted on the Website or in connection with the Service provided, whether caused by users of the Website, Users or by any of the equipment or programming associated with or utilized in the Service. Self-Match.com is not responsible for the conduct, whether online or offline, of any user of the Website or User of the Service. Self-Match.com assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, any user or User communication. Self-Match.com is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or players due to technical problems or traffic congestion on the Internet or at any Website or combination thereof, including any injury or damage to users and/or Users or to any person's computer related to or resulting from participation or downloading materials in connection with the Website and/or in connection with the Service. Under no circumstances shall Self-Match.com be responsible for any loss or damage, including personal injury or death, resulting from use of the Website or the Service or from any Content posted on the Website or transmitted to Users, or any interactions between users of the Website, whether online or offline. The Website and the Service are provided "AS-IS" and Self-Match.com expressly disclaims any warranty of fitness for a particular purpose or non-infringement. Self-Match.com cannot guarantee and does not promise any specific results from use of the Website and/or the Service.

10. Limitation on Liability.

IN NO EVENT SHALL SELF-MATCH.COM BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT DAMAGES ARISING FROM YOUR USE OF THE WEB SITE OR THE SERVICE, EVEN IF SELF-MATCH.COM HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, SELF-MATCH.COM LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO AMOUNT PAID, IF ANY, BY YOU TO SELF-MATCH.COM FOR THE SERVICE DURING THE TERM OF USERSHIP.

11. Disputes.

If there is any dispute about or involving the Website and/or the Service, by using the Website, you agree that any dispute shall be governed by the laws of the area in which we are based without regard to conflict of law provisions and you agree to personal jurisdiction by and venue in the area in which we are based.

12. Indemnity.

You agree to indemnify and hold Self-Match.com, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Service in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth above.

13. Other.

This Agreement is accepted upon your use of the Website and is further affirmed by you becoming a User of the Service. This Agreement constitutes the entire agreement between you and Self-Match.com regarding the use of the Website and/or the Service. The failure of Self-Match.com to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision. The section titles in this Agreement are for convenience only and have no legal or contractual effect. Please contact us with any questions regarding this Agreement.
